The Oklahoma Legislature is considering marijuana delivery for a second time, and allowing dispensaries to have drive-through service, said Tulsa medical marijuana attorney Stephen Cale.
Last year, Gov. Kevin Stitt vetoed a measure that included marijuana delivery. This year, State Rep. Scott Fetgatter (R-Okmulgee), introduced his HB 1960.
WHAT HB1960 WOULD DO IF PASSED INTO LAW
If passed into law, HB1960 would:
- Allow dispensaries to deliver marijuana and marijuana products to the private residence of a licensed patient, parent or guardian of a patient, or patient caregiver.
- Generally, limit delivery to a 10-mile radius from the dispensary. However, if there is no dispensary within 10 miles of the patient’s residence, then a dispensary in the same county as the patient may make the delivery.
- Require the patient to provide their license number, name, birth date, and delivery address to the dispensary.
HB2763 | ALLOWING DISPENSARY DRIVE-THROUGH SERVICE
State Rep. Ross Ford (R-Broken Arrow), introduced a bill to allow dispensaries to have drive-through service.
“Tulsa just recently repealed its ordinance prohibiting dispensary drive-throughs,” medical marijuana attorney Stephen Cale said. “A lot of patients, especially those who have a hard time getting out of their car and walking, really benefit from drive-through service.”
If passed into law, HB2763 would require a dispensaries drive-through lanes to use:
- Drawers or pneumatic tube systems for dispensing medical marijuana; and
- Drive-through windows that allow for clear visibility for verification of patient or caregiver identity.
