New Law, Rules Block Patient Drives At Dispensaries | Tulsa Medical Marijuana Attorney

New law and emergency rules have put the brakes on the way dispensaries conduct patient drives, said Tulsa medical marijuana attorney Stephen Cale.

After SQ 788 went into effect, medical marijuana dispensaries saw a way to help people get their patient cards by hosting patient drives. People could go to a dispensary, see a qualified doctor, get a recommendation for a patient license and apply for it all at the same place.

CHANGE IN THE LAW | NO MORE ON-SITE DOCTOR

But the law has changed patient drive methods. House Bill 2613, amended a portion of the Oklahoma Medical Marijuana and Patient Protection Act, and went into effect May 19, 2019. The law specifically states that “[a] physician who recommends use of medical marijuana shall not be located at the same physical address as a dispensary.”

MORE STRINGENT RULES FOR DISPENSARIES AND PATIENT DRIVES

New emergency rules going into effect September 14, 2019, places even more stringent rules upon dispensaries when it comes to patient drives, said Tulsa medical marijuana attorney Stephen Cale.

With the new rules, a doctor can’t even write a recommendation or provide medical services to a patient at a dispensary, Cale said.
