Bill Seeks Potency Limits For Oklahoma Marijuana

An Oklahoma bill seeks to limit the potency of medical marijuana, said Tulsa attorney Stephen Cale. The bill also caps potency for Delta 8 and Delta 10 THC, he said.

If passed into law, SB 440, introduced by Sen. Jessica Garvin (R-Duncan), would give the executive director of the Oklahoma Medical Marijuana Authority (OMMA) the discretion to impose potency limits.

However, the limits could not be above 30 percent (30%) for marijuana flower and 60% for marijuana products.

The cap for Delta 8 THC is set at two percent (2%). But the limit for Delta 10 THC and all other variations of THC is zero percent (0%).

If passed into law, SB 440 would go into effect Jan. 1, 2025, and it would ban dispensaries from selling marijuana a marijuana products above potency limits.
